Supplier Selection – You really need someone on your side from the get-go to ensure that the Act is being complied with in full, that you can demonstrably prove that the selection of contractors has been considered with H&S competency in mind, not just a compelling price. If the worst happened and someone is hurt on site, the HSE in their formal investigations will expect you to evidence this. This may or may not be something you feel equipped to judge. Thus, ideally we would be appointed early enough in the project to help you make and document these informed supplier choices.

On Your Side – As an independent PC, we are solely working for you and holding your contractors to account. Any safety related shortcuts a contractor may be tempted to take to protect or enhance their margins are ours to stop. Previous experience is vital here.

Managing your Budgets – we know the cost of compliance and “attendances”, we know what should be included as standard, and we know when and where its appropriate to ask for H&S related extras on the project. Understanding Your Project Requirements

The Construction (Design and Management) Regulations 2015, commonly referred to as the CDM Regulations 2015, are a key piece of legislation in the UK that governs the management of health, safety, and welfare in construction projects. Among the critical components of these regulations is the role of the Principal Contractor. The CDM Regulations 2015 were implemented to improve safety standards and clarify the roles and responsibilities of all parties involved in construction projects. These regulations apply to all construction work, from major building projects to smaller-scale renovations, and require certain duties to be fulfilled by duty holders, which include clients, designers, and contractors.

 

Roles and Responsibilities

In the complex world of construction, understanding the roles and responsibilities of various parties is crucial for the successful execution of a project. Among these roles, the Principal Contractor holds a pivotal position.

The Principal Contractor assumes primary responsibility for overseeing the construction phase of projects involving multiple contractors. Appointed by the client, there should be only one principal contractor at any given time for a project. In this context, “project” encompasses various types of construction, building, infrastructure repair, or maintenance work, regardless of whether it occurs on a permanent or temporary site. The principal contractor must possess the necessary competence, skills, knowledge, and experience relevant to the specific work and the health and safety risks associated with it. This ensures effective management and coordination throughout the construction phase, promoting safety and compliance with regulations.

Non-Compliance Under CDM

Since 2015, all construction projects undertaken in the UK must comply with the Construction Design and Management (CDM) Regulations. In our experience, our Clients’ knowledge of their far reaching legal responsibilities is worryingly low. The Client is required to assess the competence of and appoint a Principal Contractor for any project with multiple contractors. Failure to appoint a PC for your project means you, the Client, will otherwise be deemed to inherit the PC role and all responsibilities.

Of course, ignorance of the law is no defence, and the consequences of noncompliance on workplace related Health and Safety matters can be severe.
